1. Introduction

These Terms & Conditions (“Terms”) govern the use of OTR Logistics Services, including but not limited to our truck dispatch services, IFTA filing, driver recruitment, and website development services. By engaging with our services, you agree to adhere to these Terms.

2. Services Overview

We provide the following services:

  • Truck Dispatch Services: Finding and booking good-paying loads for carriers and owner-operators.
  • IFTA Filing: Assistance with accurate and timely tax filings.
  • Driver Recruitment: Helping trucking companies and carriers hire qualified drivers.
  • Website Development: Creating professional websites for trucking companies. Free website offers are contingent on signing up for dispatch services for at least one month (hosting and domain fee: $100).

3. Eligibility

  • Our services are available only to individuals or businesses that have legal capacity and the appropriate licensing to operate as carriers or trucking companies in the USA.
  • By using our services, you confirm that all information provided to us is accurate, complete, and up-to-date.

4. Payments and Fees

  • Payment for services must be made in accordance with the pricing and terms agreed upon at the time of signing up.
  • Dispatch Services Fees:
    • 4%-5% for Dry Van, Reefer, Flatbed, Step Deck, Conestoga, and Power Only.
    • 5%-6% for Hotshots.
    • 6%-7% for Box Trucks/Straight Trucks.
    • 8%-10% for Sprinter/Cargo Vans.
  • Fees are non-refundable unless explicitly stated otherwise.
  • Additional charges may apply for IFTA filing, recruitment, or other services.

5. Free Website Offer

  • The free website offer is valid only for clients who remain signed up for our dispatch services for a minimum of one month.
  • The $100 fee covers hosting and domain costs and is non-refundable.

6. No Forced Dispatch

  • OTR Logistics Services operates on a no forced dispatch policy. Carriers and owner-operators retain the final decision on accepting or rejecting loads.

7. Privacy and Data Protection

  • We respect your privacy and handle your information in accordance with our Privacy Policy.
  • Personal and business data collected during registration, recruitment, or IFTA filing will only be used for service delivery purposes.

8. Limitation of Liability

  • OTR Logistics Services will not be held responsible for:
    • Load cancellations by brokers or shippers.
    • Delays or errors in IFTA filing due to inaccurate data provided by the client.
    • Any financial losses resulting from the use of our services.
  • Our liability is limited to the amount paid for the specific service in question.

9. User Responsibilities

  • You agree to provide accurate and complete information required for our services.
  • You are responsible for maintaining compliance with federal and state regulations, including but not limited to DOT and FMCSA requirements.

10. Termination of Services

  • OTR Logistics Services reserves the right to terminate services in cases of:
    • Breach of these Terms.
    • Non-payment of fees.
    • Misuse of our platform or services.
  • Users may terminate services with written notice. Any remaining balances must be settled upon termination.

11. Dispute Resolution

  • In the event of disputes, we encourage resolution through direct communication. If unresolved, disputes will be subject to arbitration under the laws of the state where OTR Logistics Services is headquartered.

12. Intellectual Property

  • All content, logos, and designs on our website are the intellectual property of OTR Logistics Services. Unauthorized use is strictly prohibited.

13. Changes to Terms

  • OTR Logistics Services reserves the right to update or modify these Terms at any time. Changes will be communicated via our website. Continued use of our services after such updates constitutes acceptance of the revised Terms.
